Modern Cowork - Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Modern Cowork mobile application, website, memberships, and physical coworking facilities (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Services.

1. About Modern Cowork

Modern Cowork (“Modern Cowork,” “we,” “us,” or “our”) provides coworking memberships, workspace access, and related services through physical locations and a mobile application. These Terms apply to all users, members, and visitors of the Services.

2. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you have the legal capacity to enter into this agreement and that all information you provide is accurate and complete.

3. Account Registration & Responsibilities

To access certain features, you may be required to create an account.

You agree to:

- Provide accurate and up-to-date information

- Maintain the confidentiality of your login credentials

- Be responsible for all activity under your account

You may not share your account or access credentials with others. We reserve the right to suspend or terminate accounts that are misused or shared without authorization.

4. Use of the App

The Modern Cowork app is provided to allow users to:

- Manage memberships and billing

- Book rooms or workspaces

- Receive updates, notifications, and communications

We do not guarantee uninterrupted or error-free access to the app. We reserve the right to modify, suspend, or discontinue features at any time without notice.

Prohibited use includes, but is not limited to:

- Unauthorized access or interference with systems

- Abuse, harassment, or misuse of app features

- Attempting to circumvent security or access controls

5. Bookings & Space Usage

Bookings for meeting rooms, offices, or shared spaces are subject to availability and membership level.

- Bookings do not guarantee exclusive access unless explicitly stated

- Booking limits, time caps, and access rules may vary by membership

- We reserve the right to modify or cancel bookings when necessary

- No-shows or late cancellations may result in loss of booking privileges

6. Access to Facilities

Access to Modern Cowork facilities may be provided through app-based access, codes, keycards, or other methods.

You agree:

- Not to share access credentials

- Not to allow unauthorized guests unless permitted

- To comply with all posted rules and safety requirements

We reserve the right to revoke access immediately for violations, safety concerns, or non-payment.

7. Payments, Billing & Fees

Memberships may include recurring fees billed monthly or as otherwise stated.

By enrolling, you authorize us to charge your selected payment method on a recurring basis.

- Payments are processed through third-party providers

- Failed or late payments may result in suspension of access

- Membership fees are non-refundable unless explicitly stated otherwise

You are responsible for keeping billing information current.

8. Cancellations & Termination

Members may cancel their membership in accordance with the cancellation policy communicated at signup or within the app.

- Cancellations are effective at the end of the current billing cycle

- No prorated refunds are provided unless required by law

We reserve the right to terminate or suspend access at any time for violations of these Terms or misuse of the Services.

9. Code of Conduct

Users must behave respectfully and professionally while using the Services.

Prohibited conduct includes:

- Harassment or disruptive behavior

- Illegal activity

- Damage to property

- Interference with other members’ use of the space

Failure to comply may result in immediate termination without refund.

10. Intellectual Property

All content, branding, logos, software, and materials associated with Modern Cowork are owned by or licensed to us.

You are granted a limited, non-transferable license to use the Services for personal and business purposes only. Unauthorized reproduction or misuse is prohibited.

11. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Please review it carefully.

12. Disclaimers

Use of the Services and facilities is at your own risk.

- We do not guarantee productivity, outcomes, or availability

- We are not responsible for lost, stolen, or damaged personal property

Facilities are provided “as is” without warranties of any kind.

13. Limitation of Liability

To the fullest extent permitted by law, Modern Cowork shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Services.

Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Modern Cowork from any claims, damages, liabilities, or expenses arising from your misuse of the Services or violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be effective upon posting. Continued use of the Services constitutes acceptance of the updated Terms.
